Terms and Conditions of Service
1. Acceptance of termsThe following “Terms and Conditions” apply to all users of the Islam Q & A Short Code “service”. Users understand and agree to these Terms and Conditions, which may be revised from time to time without prior notice.
2. Charges
All messages sent, hereinafter known as “subscribed” messages, to “Islam Q & A” via SMS, will incur a charge of £1.00.
3. Description of "service"
Users understand and agree:
- that Islam Q & A currently provides users with the receipt of mobile device text message based premium content, which initiates at the receiving of text message based content at Islam Q & A from any UK based mobile phone number,
- that Islam Q & A may retain the phone number of the user from which the “subscribed” message was sent, as well as the “subscribed” message(s) sent from and received by that number, with respect to Islam Q & A.
- that the "service" may include advertisements, whether inside or independent of “subscribed” messages,
- that the "service" may include independent communications from Islam Q & A, such as "service" announcements, administrative messages and advertisements,
- that any addition to Islam Q & A “services”, such as MMS, shall be subject to these Terms and Conditions, unless stated otherwise,
- that Islam Q & A assumes no responsibility for deletion, mis-delivery, failure-to-deliver, failure-to-receive and all other events whereby the transmission of “subscribed” messages or their replies is affected,
- that Islam Q & A assumes no responsibility whereby the user experiences charges in excess of the stipulated amount,
- that Islam Q & A assumes no responsibility to the content of messages received or sent within this “service”,
- that Islam Q & A assumes no responsibility and shall not be held liable for damage, harm or injury caused by virtue of the content in context of the correspondence between the user and Islam Q & A, and nor by virtue of the software used by the end user in correspondence with Islam Q & A or used otherwise.
4. Obligations of the User
To avail of the “services” provided by Islam Q & A, the user must provide a valid UK based mobile telephone number, whether the user is sending that “subscribed” message via the internet (PC based), via mobile telephonic device, or otherwise. The origin of the “subscribed” message must be a valid and recognisable number to which the reply may be sent.
The “subscribed” message must be with respect to Islam, whether directly or indirectly connected.
The “subscribed” message must not exceed 160 characters, which must include ISLAM(space) at the beginning of the message.
The “subscribed” message must be a question asked in a civilised and mature manner, using common English. The usage of short cuts and slang or uncommon English may invalidate your message.
The “subscribed” message, inclusive of all of its content, shall remain the sole responsibility of the user.
5. Our obligations
Islam Q & A guarantees the accuracy of all reply content, which shall not include spelling mistakes, grammatical structure, punctuation and nor quality.
Replies to messages shall be up to a maximum of 160 characters.
References to replies may or may not be included in the message. Amount of content and discretion of replying Scholar may be factors to such replies.
Replies shall be made to all valid “subscribed” messages as soon as humanly possibly, but Islam Q & A does not guarantee the prompt receipt of such replies at the user’s end which may be due to congestion, technical factors or otherwise. If a question of challenging nature has been posed, the user may expect a delay in the response due to the want of accurate research. In such a case, the user shall receive a free message from Islam Q & A informing him/her of the receipt of his/her “subscribed” message at Islam Q & A’s end, and that it is being looked into, and that the reply shall be made soon.
Islam Q & A shall not be liable for any content received from or sent to users.
The user understands and agrees to content sent received from user as “subscribed” message requires technical processing and transmission of the "service", including his/her content, may involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
6. User restrictions
The user agrees to not use the “service” to:
a. upload, post, email, transmit or otherwise make available any content that may be unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
b. harm minors in any way;
c. impersonate any person or entity, including, but not limited to, an Islam Q & A official, Scholar or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;
d. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the “service”;
e. upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
f. upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
g. upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
j. interfere with or disrupt the "service" or servers or networks connected to the "service", or disobey any requirements, procedures, policies or regulations of networks connected to the "service";
k. intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations, any rules of any national or other securities exchange and any regulations having the force of law;
l. "stalk" or otherwise harass another; or
m. collect or store personal data about other users.
7. Indemnity
The user agrees to indemnify and hold Islam Q & A, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of content he/she submits, posts, transmits or makes available through the "service", his/her use of the "service", his connection to the "service", his violation of the “Terms and Conditions”, or his/her violation of any of the rights of another.
8. No resale of "service"
The user agrees not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the "service", use of the "service", or access to the "service".
9. Modifications to "service"
Islam Q & A reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the "service" (or any part thereof) with or without notice. The user agrees that Islam Q & A shall not be liable to the him/her or to any third party for any modification, suspension or discontinuance of the "service".
10. Termination
The user agrees that Islam Q & A may, without prior notice, decline to reply to any question without any reason. Cause for such denial of response shall include, but not be limited to, (a) breaches or violations of the “Terms and Conditions” or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you, (d) discontinuance or material modification to the "service" (or any part thereof), and (e) unexpected technical issues or problems. Further, the user agrees that all terminations for cause shall be made in the sole discretion of Islam Q & A and that Islam Q & A shall not be liable to the user or any third-party for any denial of response, any associated mobile telephone number or access to the "service".
11. Dealings with advertisers
The user’s correspondence or business dealings with, or participation in promotions of, advertisers found on or through the "service", including payment and delivery of related goods or “services”, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. The user agrees that Islam Q & A shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the "service".
112. Proprietary Rights of Islam Q & A
The user acknowledges and agree that the "service" and any necessary software used in connection with the "service" contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the "service" or advertisers is protected by copyrights, trademarks, "service" marks, patents or other proprietary rights and laws. The user agrees not to, and is legally obliged not to, modify, rent, lease, loan, sell, distribute or create derivative works based on the "service" or the Software, in whole or in part, unless expressly authorised by Islam Q & A.
12. Disclaimer Of Warranties
The user expressly understands and agrees that:
a. your use of the "service" is at your sole risk. the "service" is provided on an "as is" and "as available" basis. Islam Q & A expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
b. Islam Q & A makes no warranty that:
(i) the "service" will meet your requirements,
(ii) the "service" will be uninterrupted, timely, secure, or error-free,
(iii) the results that may be obtained from the use of the "service" will be accurate or reliable,
(iv) the quality of any products, "services”, information, or other material purchased or obtained by you through the "service" will meet your expectations, and
(v) any errors in the software will be corrected.
c. any material downloaded or otherwise obtained through the use of the "service" is done at your own discretion and risk and that you will be solely responsible for any damage to your computer system, or device, or loss of data that results from the download of any such material.
d. no advice or information, whether oral or written, obtained by you from Islam Q & A or through or from the "service" shall create any warranty not expressly stated in the “Terms and Conditions”.
13. Limitation Of Liability
You expressly understand and agree that Islam Q & A shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Islam Q & A has been advised of the possibility of such damages), resulting from:
(i) the use or the inability to use the "service";
(ii) the cost of procurement of substitute goods and "services” resulting from any goods, data, information or "services” purchased or obtained or messages received or transactions entered into through or from the "service";
(iii) unauthorised access to or alteration of your transmissions or data;
(iv) statements or conduct of any third party on the "service"; or (v) any other matter relating to the "service".
14. Notice of updates etc.
All Terms and Conditions may be modified, revised, amended and updated at any time without notice to the user.
15. Title
Islam Q & A, and its Short Code service, may be referred to with the titles 'Islam QA', 'IslamQA', 'Islam Q & A', and 'Islam Q and A' at all times, or from time to time, unless expressly stated otherwise.
16. Disclaimer
Islam Q & A offers single use and subscription mobile downloads and you must have permission from the bill-payer of the mobile before using any services. Standard WAP, GPRS/Internet and SMS costs apply so please check with your operator for charges. Pre-pay users ensure you have enough credit to receive texts. Please also make sure that your phone is compatible. Services usually take a few minutes to arrive but delays can be caused by network congestion so please allow up to 24hrs for delivery.
